There’s no mystery to the Building Code of Australia here. Some have described this recent Supreme Court of NSW case as "controversial". By any measure, we can't understand why. This case note looks at the interpretation of the term “Effective Height” in the Building Code of Australia and in doing so, reminds Building Surveyors and Building Practitioners how a court approaches statutory interpretation.
