The General Assembly convened for the 2015 legislative long session on January 14 and adjourned September 30. Lawmakers will return to Raleigh for the short session April 25, 2016. The MVA Public Affairs Legislative Report on North Carolina will be distributed on a bi-weekly basis during the interim to keep you up to date on the latest legislative issues facing the state.

Committees

House Rules Committee

The Committee met multiple times this week and approved the following bills:

  • H 805, Measurability Assessments, would establish the North Carolina Measurability Assessment Act of 2015 to provide for assessments of State programs.
  • S 119, GSC Technical Corrections 2015, makes technical changes recommended by the General Statutes Commission and various other changes to State law.
  • S 313, Industrial Hemp, recognizes the importance and legitimacy of industrial hemp research and promotes increased agricultural employment.
  • S 519, Amend Child Custody Laws, promotes the encouragement of parenting time with children by both parents.
  • S 524, Grad Req/ Sports Pilot, would (i) make changes to the Founding Principles Act, and (ii) authorize the Department of Public Instruction (DPI) to use funds to conduct a pilot program on integrated community-based adapted sports programs for students with disabilities.
  • S 670, Term Limits for BOG Members, limits members of the Board of Governors of The University of North Carolina to no more than three terms and establishes a process for the selection of a president for The University.
  • S 694, Reegan’s Rule/Enforce Pharm. Ben. Mgt., would require parent education during well-child visits at specific age intervals regarding Type I Diabetes and amend the law pertaining to Pharmacy Benefits Managers (PBMs).
  • S 721, Adjournment Resolution, adjourned the General Assembly until April 25, 2016.

Senate Rules Committee

The Committee met multiple times this week and approved the following bills: 

  • H 647, Epi Pens in All Child-Serving Businesses, permits the prescribing and dispensing of epinephrine auto-injectors to authorized entities at which allergens capable of causing anaphylaxis may be present. The bill allows trained employees or agents of the authorized entities to provide or administer epinephrine under certain circumstances to specified individuals and provides immunity for individuals acting in accordance with the bill. The bill specifies that actions taken pursuant to the act do not constitute the practice of medicine and allows the Board of Pharmacy to adopt rules     addressing the authorization for authorized entities to obtain a     prescription for epinephrine for emergency health circumstances. 
  • H 558, Reserve and National Guard/Military Affairs Committee, adds two voting members to the North Carolina Military Affairs Commission to be appointed by the Governor. One of the new members must be a current or retired member of the North Carolina National Guard and the other must be a current or retired member of a reserve component of the United States Armed Forces. 
  • H 735, DPS Changes, makes various changes related to the Department of Public Safety. 
  • H 126, Mortgage Origination Support Registration, amends the Secure and Fair Enforcement Mortgage Licensing Act to authorize the Commissioner of Banks to implement a registration system for persons engaged exclusively in the processing or underwriting of mortgage loans and not engaged in the mortgage business.
