NY Nursing Home Settles Fraud Suit

On March 4, the New York Attorney General announced an $8.6 million settlement with Fulton Commons Care Center, a nursing home located in East Meadow, NY. The settlement resolves an action brought against Fulton in 2022 claiming financial fraud, physical abuse, mistreatment of residents, and covering up resident complaints.

The AG had previously sued the nursing home, but unfortunately the first suit did not have its intended results. Ideally, resident complaints should have led to self-corrective action by Fulton. Two Fulton employees involved in wrongdoing were indicted in 2022.

As part of the new settlement, Fulton agreed to take corrective actions and install an independent financial monitor to ensure that the fraudulent financial transactions uncovered would not reoccur. Fulton also pleaded guilty to criminal acts relating to the cover-up of reports of sexual assaults against residents in 2020 and 2022.

Of the $8.6 million settlement, $7 million will be used to implement resident safety reforms and $1.6 million will be refunded to the Medicare and Medicaid programs.
