Opinion on Appeal in Eminem Case on Royalties vs License


The 9th Circuit Court of Appeals reversed the district court's ruling and held that third party digital distribution of sound recordings is a "license" and as such the sound recording copyright owner is entitled to 50 percent of the income and not the royalty rate set forth under the contract.
