Court allows Plaintiff's claims seeking to unwind fraudulent transfer of trademarks to go forward.

This is an action to enforce a judgment against gambling giant Bodog. After judgment was entered against it, it transferred trademarks to related entities. This lawsuit seeks to set aside those transfers on the basis that they violate Washington's fraudulent transfer statute. Defendants moved to dismiss on various grounds. The court's order denies Defendants motion to dismiss.

The court rejected two arguments raised by Defendants: (1) courts cannot transfer marks involuntarily and (2) federal law preempts state law on trademark transfers.
