This Order was entered granting my client's demurrer based on Virginia law concerning the appropriate use of Declaratory Judgments when coupled with requests for Injunctive relief. The demurrer was granted, the complaint was dismissed without prejudice. A suspending order was entered to allow Defendant's motion for sanctions against Plaintiffs and attorney Due H. Tran, Esq.

The appeal by Due H. Tran, Esq. has been denied by the Supreme Court of Virginia and the Order of the trial court stands.
