Federal judge rules that a report prepared by an expert five months before lawsuit is filed is a "draft" and therefore not subject to disclosure under the December 2010 amendment to Rule 26 of the Federal Rules of Civil Procedure. Should help protect those "reports" that carriers sometimes demand from experts before involving counsel.
