While debate abounds regarding the unacceptable restraints on lawyers to practice law caused by the 'unfinished business' doctrine as applied to failed law firms, a massively greater restriction churns along unnoticed and accepted by law firms across the country. It may be time to revisit what the profession says and what it means about 'restraints', because this elephant in the room is taking up too much space.
