Gathering Information Up Front: Interrogatories

One of the best changes I have ever made to my practice was giving my clients interrogatories at the time they sign up for representation with our firm. Each and every personal injury client is given a copy of standard personal injury interrogatories to complete within the first ten days of signing up with our firm. First, this gives the client the opportunity to provide information to us for each and every medical provider, prior accident, prior lawsuit, and other essential information to the claim. Second, this eliminates that wonderful moment the occurs from time to time, the moment a client forgot to tell you about a prior accident or injury and it comes out at deposition or mediation or, even worse, trial! Third, what I believe to be the most important thing, is that this is a great CYA document. If a client fails to provide you with information, you’ve got documentation from the beginning that you were operating under the premise that the information they provided to you in the interrogatories was truthful and accurate. In fact, we go ahead and notarize the document too!
