Plaintiff's Memorandum in Opposition to Partial Motion for Summary Judgment


This Memorandum of Law was filed in opposition to the defendants' Motion for Partial Summary Judgment in a trucking accident case. The defendants sought summary judgment as to our claims of recklessness. The case involved a rear-end collision; defendants' tractor-trailer collided with the plaintiff's stopped vehicle, a VW Beetle. As a result of the collision, the plaintiff suffered a serious brain injury. The defendants admitted negligence but denied recklessness. The case was tried before a jury, resulting in a verdict of $2,523,500.00.
