This is an opposition to a motion to dismiss filed in a mandamus action by a contractor to compel the State of Connecticut Department of Public Works to pay the plaintiff the sums certified by the Governor to be paid pursuant to C.G.S. 3-7. The defendants moved to dismiss the complaint on the ground that sovereign immunity barred the action and that the plaintiff had adequate alternative remedies to a mandamus action. The trial court denied the defendants' motion and subsequently entered judgment in the plaintiff's favor. However, the Connecticut Supreme Court reversed the trial court's decision.
