The Courtroom and DMV generally represents a hostile environment to the needs of persons accused of a DUI. This is particularly true for persons whose careers depend on maintaining a valid driver's license. A commercial license is suspended for one year in California if a person is convicted of a DUI or loses their administrative hearing. You have to prevail in both. This newsletter is about one case where our firm was able to overcome the adversarial environment when our client, a public transit driver was accused of committing a DUI on his personal time.
In addition the newsletter contains a DUI law update and describes how law enforcement despite knowledge they are using a defective breath test machine continue to arrest and accuse 1000's of persons of DUI. Morevoer, the Courts and DMV continue to enforce the officer's actions using this unreliable evidence despite the effect it has on so many people's lives.
