Proposed Legislation Would Eliminate Annual Pay Notice Requirements Under The Wage Theft Prevention Act

During the last month, our clients have devoted much time and effort to comply with the annual pay notice requirement 
of the New York Wage Theft Prevention Act (the “Act”).  We have also fielded numerous client questions regarding 
ambiguities in the statute and Department of Labor Guidelines.  Therefore, we want to advise you that a bill has been 
introduced in the New York State Legislature to amend the Act, which, if passed, would repeal the annual pay notice 
requirement.  (The parts of the Act requiring pay notices for new hires or for employees whose pay is reduced would not be 
changed.)  The bill is A 8856/S6063, and the principal sponsors are Assemblyman Dennis Gabryszak and Senator John 
DeFrancisco.  You may wish to contact your state senator and assembly member regarding your position on this proposed 
amendment.
