Public Notice Town Of Ovid: Resolution Authorizing Transfer Of Surplus Property To The Village Of Ovid, Subject To Permissive Referendum



Notice is hereby given that the Town Board of the Town of Ovid, Seneca

County, New York at a meeting thereof, held on July 24, 2013, duly

adopted, subject to a permissive referendum, a resolution, an abstract

of which is as follows:



WHEREAS, the Town of Ovid acquired a parcel of land located at 7160 MAIN STREET

OVID, NY 14521 by deed dated June 9, 1993 and recorded in the Seneca

County Clerk's Office on July 22, 1993 in Liber 507 of Deeds at Page

70 for the purpose of municipal office space and

WHEREAS, it is no longer necessary for the Town to retain said property, and

WHEREAS, the Village of Ovid has offered to purchase the aforesaid

real property upon the following terms and conditions:

The Village of Ovid hereby agrees to accept a conveyance from the Town

of Ovid of the real property previously conveyed to said Town by deed

dated June 9, 1993 and recorded in the Seneca County Clerk's Office on

July 22, 1993 in Liber 507 of Deeds at Page 70.

The conveyance from the Town of Ovid to the Village of Ovid is

conditioned upon the Village of Ovid simultaneously conveying the

subject property to Grant Management Associates, Inc. for the

consideration of $30,000.00 which said amount will be paid to the Town

of Ovid in consideration of its conveyance to the Village of Ovid.

Any resolution of the town board approving this purchase and sale

agreement shall not take effect until at least thirty days after its

adoption. This purchase and sale agreement and any resulting

conveyance shall be subject to the requirements of the permissive

referendum procedure, pursuant to Town Law § 64(2), Town Law § 91 and

such other and further applicable statutes and case law.

The conveyance by the Town of Ovid shall not include the heating or

air conditioning units previously installed in the building by the

Town of Ovid, which said units shall be removed by the Town of Ovid

prior to the conveyance to the Village of Ovid. The remaining property

is conveyed "as is". The conveyance shall be completed within sixty

(60) days of acceptance of this offer by the Town, subject to any

permissive referendum.

The Town of Ovid shall be responsible for deed stamps payable to the

Seneca County Clerk in the amount of $120.00 and filing the TP-584 in

the amount of $5.00 and shall be responsible for the preparation of

the deed, TP-584 and RP-5217 conveying marketable title to the

property free and clear of any liens and encumbrances. The Village of

Ovid will be responsible for its own recording and filing fees.

NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of

Ovid in session duly convened does hereby authorize and direct the

Town Supervisor of said Town to accept the above described purchase

and sale agreement and to execute and deliver to said Village of Ovid

a corporate deed or covenant against grantor deed conveying the

former/current town municipal offices, described above, upon the above

terms and conditions, subject to a permissive referendum as permitted

by law.
