At the June Associated General Contractors (AGC) of Arkansas membership luncheon, I had the opportunity to present on public-private partnerships projects (P3s), the statutory authority for infrastructure P3 projects in Arkansas, and how the design and construction industries in Arkansas would be impacted by a P3 project in the state.

The presentation focused on: (1) the P3 Concept, which discusses the general purpose of a P3 project delivery method; (2) the Structure of P3s and the illustration of the contract relationships between the contractor, developer, lender, investor, and government agency; (3) Key Elements of a P3 with an emphasis on design-build-operate-maintain (DBFOM) projects and value for money analysis; and (4) Types of P3’s in Arkansas, including the impact on owners, contractors, suppliers, and construction law in Arkansas in general.
