The area of 3rd party custody and visitation in Maryland is changing. Maryland courts recognizes the fundamental rights of parents to care for their children. There is now an test that must be overcome by third parties before the court looks at the "best interest" test we are all familiar with. The test: whether the parent is unfit or does exceptional circumstances exist? Many recent cases have further developed what exceptional circumstances mean and what it does not mean.
