Saskatchewan Government sought to shield reference checks providers identities and actual references provided from the Union and grievor, citing Freedom of Information and Protection of Privacy Act. Arbitrator Dan Shapiro ruled that neither the Provincial Act (FOIPPA) nor the Federal Act (PIPEDA) shielded the Government,the reference check providers, or the contents of the references from the scrutiny of the Union or the Arbitration Board
