Reminder for Lobbying Disclosure Act Registrants

The fourth quarter federal lobbying activity reports, covering the period from October 1, 2018 through December 31, 2018, are due on Tuesday, January 22, 2019. The government shutdown has not resulted in an extension of time to file nor has it impaired filers’ ability to access the online filing system.

New disclosure requirements contained in the Justice Against Corruption on K Street Act (JACK Act), signed by President Trump on January 3, 2019, and effective immediately, will not affect the fourth quarter filings. The JACK Act requires filers to disclose details of a listed lobbyist’s state or federal conviction for an offense involving bribery, extortion, embezzlement, an illegal kickback, tax evasion, fraud, a conflict of interest, making a false statement, perjury or money laundering. This new disclosure obligation applies to registrations and to quarterly reports and requires the disclosure of both the date of a conviction and a description of the offense. The online reporting forms have not yet been modified to accept these additional disclosures; filers with conviction information to disclose should nonetheless continue to submit timely registrations and quarterly reports.
