Republican AGs Warn DOJ of Potential Threat Posed by Foreign Third-Party Litigation Funding

  • A group of 14 Republican AGs wrote a letter to Merrick B. Garland, the U.S. Attorney General, asking what steps the DOJ is taking to protect against potential threats posed by foreign entities funding civil litigation within the United States.
  • In the letter, the AGs noted that, although the practice of third-party litigation funding has expanded rapidly in the past few years, it is impossible to gauge exactly how much of this funding is coming from foreign adversaries. They expressed concern that foreign actors hostile to the U.S. could leverage strategic lending to threaten U.S. economic and national security interests, effectively weaponizing the U.S. judicial system.
  • The AGs urged the implementation of a federal strategy to protect the court system from foreign interference, and asked AG Garland to clarify what the Justice Department is doing to address the concerns elucidated in their letter.
