For a witness that is represented by counsel:

We will stipulate that the court reporter may be relieved of her duties under the code; that she will forward the original transcript to witness’ counsel for reading/signing; that the witness will have 30 days (or a shorter time frame if necessary) to read/sign; that witness’ counsel will notify all counsel within five days (or any time frame agreed upon) of any changes made and the fact that the transcript has been signed; that counsel for the witness will maintain custody of the original and produce it at trial or any hearing when requested to do so; that if the original is lost or not available at the time of the hearing/trial, a Certified Copy may be used in its place.

For a percipient witness:

We will stipulate that the court reporter will be relieved of her duties under the code; that she will forward the original transcript to the witness for reading/signing enclosing a pre-stamped, pre-addressed envelope for the transcript to be sent to myself, the noticing attorney (or sent back to the court reporter).   I will advise all counsel of any changes made and the fact that the transcript has been signed within five days of my receipt.  I will maintain custody of the original and produce it at the time of trial or any hearing in this matter; that if the original is lost or not available at the time of the hearing/trial, a Certified Copy may be used in its place.

For a percipient witness wherein the attorney would prefer the court reporter to seal original:

We will stipulate that the court reporter will be relieved of her duties under the code; that she will forward the original transcript to the witness for reading/signing enclosing a pre-stamped, pre-addressed envelope for the transcript to be sent back to the court reporter, the court reporter will advise all counsel of any changes made and the fact that the transcript has been signed within five days of receipt.  She will then go by code, seal the transcript, and send it to my attention as the noticing attorney for filing with the court.  If the witness never transmits the original transcript back to the court reporter, a Certified Copy may be used in its place.

WARNING:  If attorneys stipulate away the original in any geographical location outside of Southern California, expect to be surcharged for doing so by the court reporter for the cost of a certified copy (approx. $2+ per page).  The court reporters believe that attorneys are giving away their work product.  I advise my clients to go by the Code or Federal Rules when conducting depositions outside of Southern California.
