Russian Court Recognizes a Northern Ireland Court Decision in Order to Fullfill International Legal Obligations to Combat Corruption

This alert examines a recent resolution of the Presidium of the Supreme Commercial Court of the Russian Federation (“SCC”), No. 6004/13, dated 8 October 20131 (“Resolution”), which recognized in the Russian Federation the resolution2 (“Foreign Court Decision”) of the High Court of Justice of Northern Ireland (“Northern Ireland court”) with respect to the claim brought by Demesne Investments Limited (“Demesne”) and the Quinn Group companies against Galfis Overseas Limited (“Galfis”). In this case, and for the first time, a foreign court decision was recognized inorder to fulfil the international legal obligations of the Russian Federation to combat corruption in accordance with the United Nations Convention against Corruption, dated 31 October 2003 (“Anti-Corruption Convention” or “Convention”).
