This article reviews the Defense of Marriage Act (DOMA) and how state law legalizing same sex marriage conflicts with the federal law. It examines two areas specifically: immigration and divorce. This is becoming a legal issue that attorneys may soon be overwhelmed with in light of New York legalizing same sex marriage. The article helps legal practitioners who may practice in states outside of those with legal same sex marriage with some of the issues they may find clients coming to them with in the near future, and how to advise them to proceed.
