Defendants in complex tort cases increasingly find

that multiple plaintiffs have joined their claims together,

or that they have been joined with a multitude of other

defendants (often responsible for very different products)

in a single action. While it may sometimes be

appropriate for these claims to be joined, more

commonly such joinder is a scatter-shot approach to litigation

often motivated by plaintiffs
