The Center for Biological Diversity and Tennessee Riverkeeper (collectively “CBD”) entered into a Settlement and Release Agreement (“Agreement”) with Mazda Toyota Manufacturing, U.S.A. (“Mazda”) addressing potential Endangered Species Act (“ESA”) issues related to the spring pygmy sunfish (“Sunfish”).

The Agreement is intended to minimize impacts from a planned automobile manufacturing facility in Huntsville, Alabama.

The Agreement will protect at least 1,100 acres of the Beaver dame Spring and Creek Complex. This area includes habitat for the Sunfish.

The Agreement also provides $6 million to conserve the species and its habitat.

CBD had previously sent an ESA Notice of Intent to Sue related to alleged implications of the development of a manufacturing plant in the area.
