Storage Tank Enforcement: U.S. Environmental Protection Agency and Illinois Village Enter into Expedited Settlement Agreement

The United States Environmental Protection Agency (“EPA”) and the Village of Oak Park, Illinois (“Oak Park”) entered into a January 8th Expedited Settlement Agreement (“ESA”). See R5-UST-21-001-AC.

The ESA addresses an alleged violation of the federal Underground Storage Tank Regulations.

The alleged violation of the UST regulations is stated to include:

Failure to conduct periodic walkthrough inspection every 30 days.

40 C.F.R. § 280.36(a) is cited.

Oak Park is stated to be the owner or operator of the UST.

The ESA assesses a civil penalty of $670.
