Stormwater Enforcement: Mississippi Commission on Environmental Quality and Foxworth Sawmill Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Marion County Timber, Inc. (“Marion”) entered into a May 2nd Agreed Order (“AO”) addressing an alleged violation of the Mississippi statute implementing the Clean Water Act.

The AO indicates that Marion operates a sawmill (“Facility”) in Foxworth, Mississippi.

MCEQ conducted a Compliance Evaluation Inspection of the Marion Facility on March 30, 2022, and identified the following alleged violation:

  • Miss. Code Ann. 49-17-29(2)(b): Respondent discharged stormwater prior to obtaining coverage under Mississippi's Industrial Storm Water General NPDES Permit.

Marion is stated to have submitted an Industrial Stormwater Notice of Intent for Coverage Under the Industrial Stormwater General NPDES Permit on September 28, 2022.

The Mississippi Environmental Quality Permit Board subsequently issued a Certificate of Permit Coverage to Marion on December 5, 2022, for coverage under Mississippi’s Industrial Storm Water General NPDES permit.

The AO assesses a civil penalty of $11,250.
