Supreme Court Upholds Obamacare Tax Subsidies

Earlier today the United States Supreme Court announced its decision upholding tax subsidies for individuals who obtain health coverage in a state that has a Federal Exchange. The Court's 6-3 opinion in King v. Burwell is here.

With this decision, the implementation of Obamacare is almost complete. Employers must continue to make plans to implement the employer mandate in 2015 and in 2016 for smaller employers. Planning must continue to implement the new IRS reporting requirements which will be due in early 2016. In addition, the Cadillac tax looms on the horizon for 2018.

Undoubtedly the political debate on Obamacare will continue, especially as we enter a Presidential election year, but, for now, the debate in the Supreme Court is over.
