The biggest threat to justice in America is the successful propaganda campaign by big business, the health and the insurance industry, and the U.S. Chamber of Commerce against trial lawyers, particularly contingency fee trial lawyers. The contingency fee system screens out frivolous cases; it doesn't encourage them. Contingency fee trial lawyers don't want to risk their time and money on frivolous cases, and clients who can scarcely afford a one hour consultation with a lawyer should have access to the system. When citizens conclude that the system does not deliver justice, they will ultimately revolt against it. Frivolous lawsuits are rare, but propaganda against those who would avail themselves of the system by hiring contingency fee trial attorneys threatens the American system's ability to deliver justice for all.
