The Future Is Sooner Than You Thought: Effective Dates for School Law Changes in Michigan

In 2023, the Michigan Legislature enacted a series of Public Acts that significantly changed laws impacting public education in kindergarten through grade 12. Some of these laws had specified effective dates, and others were effective on the 91st day after the adjournment of the legislature sine die, or without a date. That adjournment took place on Nov. 14 – weeks earlier than in the past. It is important to know the effective dates of the acts summarized below:

Public Acts 110 & 111 License reciprocity for teachers and counselors. July 27, 2023.
Public Act 26 Use of sinking funds for purchases of school buses. Aug. 6, 2023.
Public Act 46 Training for mandatory reporters under the Child Protection Law. Sept. 27, 2023.
Public Act 51 Student discipline. Sept. 27, 2023.
Public Act 57 Provision of materials related to sexual assault and harassment to students in grade 6 through 12 starting with the 2024-2025 school year. Oct. 10, 2023.
Public Act 7 Repeal of reading by grade 3 requirement. Feb. 13, 2024.
Public Act 9 Repeal of “Right to Work” laws in the public sector. Feb. 13, 2024, subject to US Supreme Court decision in Janus v. AFSCME.
Public Act 10 Restoration of the prevailing wage laws. Feb. 13, 2024.
Public Act 34 Repeal of A through F grading system for public schools by the Michigan Department of Education. Feb. 13, 2024.
Public Act 113 Repeal of PA 54 of 2011 which froze wages and benefits upon the expiration of a collective bargaining agreement, and which prohibited retroactivity. Feb. 13, 2024.
Public Act 114 Repealed prohibition on public school districts collecting union dues. Feb. 13, 2024.
Public Act 115 Repeal of the list of prohibited subjects of bargaining which was added to the Public Employment Relations Act in 2011. Feb. 13, 2024.
Senate Bills 395 & 396 Teacher evaluations. These have not been signed by the Governor or assigned Public Act numbers at this time. Feb. 13, 2024, assuming signature by the Governor
Public Act 116 Teacher layoff. July 1, 2024.
