The Supreme Court Update - February 29, 2024

Dorsey & Whitney LLP

On February 28, 2024, the Supreme Court of the United States granted certiorari in one case:

Trump v. United States, No. 23-939: This case concerns the criminal prosecution of former President Donald Trump in Special Counsel Jack Smith’s investigation into the events of January 6, 2021. Trump sought a stay of the D.C. Circuit Court’s decision affirming the district court’s rejection of Trump’s presidential immunity defenses. Treating the application for a stay as a petition for a writ of certiorari, the Supreme Court scheduled the case for oral argument on April 22, 2024, to consider the question of: “Whether and if so to what extent does a former President enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office.” In granting certiorari, the Court further stated that “[w]ithout expressing a view on the merits,” the D.C. Circuit Court is to “continue withholding issuance of the mandate until the sending down of the judgment of this Court.”
