The United States Army Corps of Engineers (Vicksburg District) (“Corps”) issued a September 6th Public Notice referencing an after-the-fact Clean Water Act Section 404 permit application by LJL Investments, LLC (“LJL”).

The Public Notice states that LJL is developing residential lots and recreational lots for purchase.

The project site is described as 190 acres in size and located in Garland County, Arkansas. The project is stated to require the placement of “numerous stream crossings for roads and access to platted lots.” However, it further states that no wetland impacts would occur as a result of the proposed work.

After-the-fact impacts are stated as including the placement of four culverts within streams on-site, and the realignment of a 290 linear foot long segment of intermittent stream channel. Proposed road crossings are stated to include two natural, at-grade stream crossings, two 24-inch by 20 foot long plastic culverts, and an additional 24-inch by 20 foot long plastic culvert to be placed adjacent to an existing 15-inch diameter culvert. These are described as being placed within ephemeral streams. Additional crossings are referenced for ephemeral streams and roadside drainage ditches to provide lot access.
