The Consolidated Appropriations Act of FY23 created new American Rescue Plan Act (ARPA) eligibility – to include response to natural disasters, to build critical information, and support community development. On August 10, 2023 the Department of Treasury issued an interim 2023 ARPA Rule. This rule provides the guidance and parameters of the new eligibility. The existing uses and 2022 Final Rule remain unchanged.

The 2023 Interim Rule created new eligibility categories for the use of ARPA funds. It is important to note, it did not add additional funds to the total ARPA awards received. Recipients are permitted to utilize ARPA funds for the new eligible categories for costs incurred beginning December 29, 2022.  

The newly added additional eligible use categories are:

  1. Emergency Relief from Natural Disasters
  2. Surface Transportation Projects 
  3. Title I of the Housing and Community Development Act
