The Court of Justice of the European Union has confirmed in its judgment in the case of Azko Nobel Chemicals Ltd and Akcros Chemicals Ltd -v- European Commission that legal professional privilege does not attach to communications between an in-house lawyer and his or her employer in relation to the exercise of the European Commission's powers of investigation.

This is an important case for in-house lawyers throughout Europe and particularly those working with companies subject to competition issues
