Used Oil Enforcement: Alabama Department of Environmental Management Announces Enforcement Action Against Trussville Transporter

The Alabama Department of Environmental Management (“ADEM”) stated it has issued a Notice of Violation (“NOV”) to Alabama Oil & Gas Recovery, Inc. (“Alabama Oil”).

Alabama Oil is described as a former used oil transporter that operated a transfer facility (“Facility”) in Trussville, Alabama.

The NOV is stated to direct Alabama Oil to:

  • Properly close its tank systems and container storage areas
  • Remove and properly manage materials stored there

ADEM states that the company:

. . . failed to properly close the tank systems and container storage area, and failed to remove or decontaminate containment systems, contaminated soils, and structures and equipment contaminated with used oil.

ADEM also states that the company did not have a current Alabama Used Oil Transport Permit.

The Facility was stated to have been inspected on January 24th. Further, the news release states that water monitoring downstream of the Facility is stated to have shown no impacts to water quality.

Alabama Oil is required to submit a response detailing what actions have been or will be taken to address the violations within 30 days of receipt of the NOV.
