The Louisiana Department of Environmental Quality (“LDEQ”) and Quality Testing, Inc. (“QTI”) entered into a Settlement Agreement (“SA”) addressing alleged violations of the Louisiana Used Oil and Hazardous Waste Regulations.
QTI is stated to own and/or operate an industrial equipment testing facility (“Facility”) in Baton Rouge, Louisiana.
The Facility is stated to specialize in the testing of physical properties of metallic materials using:
- Industrial bandsaws
- Computer numerical control
- Milling machines
- Test equipment
LDEQ is stated to have conducted an inspection and a subsequent file review of the Facility to determine the degree of compliance with the Louisiana Environmental Quality Act and certain regulations.
The violations allegedly identified include:
- Failure to properly label containers storing used oil
- Causing and/or allowing the discharge of pollutants without a permit
- Failure to determine if solid waste generated at the Facility is a hazardous waste
- Failure to obtain an active EPA identification number by notifying the Office of Environmental Services using the Notification of Hazardous Waste activity
A payment of LDEQ of $7,200 is assessed of which $1,659.25 is stated to represent the agency’s enforcement costs.
QTI denies it committed any violations or that it is liable for any fines, forfeitures, and/or penalties.
