Deferred Enforced Departure and Temporary Protected Status have been designated for Venezuelan nationals, or individuals with no nationality who last habitually resided in Venezuela, and who are currently residing in the United States.
Deferred Enforced Departure (DED) is a mechanism granted by the President to allow individuals from the designated country to remain in the United States without fear of removal from the country.
Temporary Protected Status (TPS) is a protection granted to individuals of designated countries by the Secretary of Homeland Security which deems that individuals temporarily cannot safely return to their home country.
Who should apply?
Venezuelan nationals or stateless individuals who last habitually resided in Venezuela who have been present in the United States since March 8, 2021, should consider applying for TPS whether or not they currently have legal status. TPS does not prevent individuals from obtaining or maintaining a nonimmigrant status.
Currently with non-immigrant status
For eligible individuals who currently have non-immigrant status, TPS could provide a valuable backup work authorization card or bridge to other immigration statuses and processes.
Currently without status
For eligible individuals who are currently in the United States without status, TPS could provide work and travel permission as well as protection from removal during the designation period. TPS and DED can also help prevent deportation for those in removal proceedings.
Applying for TPS
To a apply for TPS, certain requirements must be met which include:
- Venezuela nationality or having lost nationality but last residing in Venezuela;
- Filing during the registration window (Registration period is from March 9, 2021, through September 5, 2021); and
- Continuous presence in the United States from March 8, 2021, to the present date of applying.
Currently, TPS is designated through September 9, 2022.
Note: those who have prior crimes may be ineligible for applying for this remedy.
Applying for DED
DED was granted on January 20, 2021 and provides deferment of removal for 18 months (through July 20, 2022).
To apply for DED, these requirements must be met:
- Physical presence in the United States on January 20, 2021;
- Continuous presence in the United States since January 20, 2021; and
- Eligible for DED.
Note: those who have prior crimes may be ineligible for applying for this remedy.

La Salida Forzada Diferida y el Estatus de Protección Temporal han sido designados para ciudadanos venezolanos o personas sin nacionalidad quienes residieron habitualmente en Venezuela por última vez y que actualmente residen en los Estados Unidos.
La salida forzada diferida (DED) es un mecanismo otorgado por el presidente para permitir que las personas del país designado permanezcan en los Estados Unidos sin temor a ser expulsadas.
El Estatus de Protección Temporal (TPS) es una protección otorgada a personas de países designados por el Secretario de Seguridad Nacional que considera que las personas no pueden regresar temporalmente de manera segura a su país de origen.
¿Quién debería solicitar TPS?
Los ciudadanos venezolanos o apátridas que residieron habitualmente en Venezuela por última vez y que han estado presentes en los Estados Unidos desde el 8 de marzo de 2021, deben considerar solicitar el TPS, tengan o no estatus legal actualmente. TPS no impide que las personas obtengan o mantengan un estatus de no inmigrante.
Actualmente con estatus de no inmigrante
Para las personas elegibles que actualmente tienen un estado de no inmigrante, TPS podría proporcionar una valiosa tarjeta de autorización de trabajo y un puente a otros estados y procesos de inmigración.
Actualmente sin estatus
Para las personas elegibles que se encuentran actualmente en los Estados Unidos sin estatus, TPS podría proporcionar permisos de trabajo y viaje, así como protección contra la expulsión durante el período de designación. TPS y DED también pueden ayudar a prevenir la deportación de aquellos en proceso de deportación.
Solicitar TPS

Solicitar DED
La DED se otorgó el 20 de enero de 2021 y proporciona un aplazamiento de la deportación durante 18 meses (hasta el 20 de julio de 2022).
Para solicitar DED, se deben cumplir estos requisitos:
- Presencia física en los Estados Unidos el 20 de enero de 2021;
- Presencia continua en Estados Unidos desde el 20 de enero de 2021; y
- Elegible para DED.
