Wastewater Enforcement: Mississippi Commission on Environmental Quality and City of Booneville Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and City of Booneville, Mississippi, (“Booneville”) entered into a February 7th Agreed Order (“AO”) addressing an alleged violation of a Clean Water Act National Pollutant Discharge Elimination System (“NPDES”) permit. See Order No. 7234 23.

The AO provides that Booneville is a City in Mississippi.

The AO alleges that Booneville was contacted by MCEQ and notified of the following violation:

Condition No. S-8 of NPDES Permit No. MS0042030: Respondent failed to submit an application for the renewal of the permit (renewal application) to the Mississippi Environmental Quality Permit Board (Permit Board) at least 180 days prior to the expiration date of the permit. The permit expired on November 30, 2022; therefore, a renewal application was due on June 3, 2022.

Booneville subsequently submitted a renewal application on November 23, 2022. Further, the Mississippi Department of Environmental Quality determined the application to be complete on November 30, 2022.

The AO provides that Booneville agrees to comply with the terms and conditions of the expired NPDES permit until such time as the renewed NPDES permit is acted on by the Permit Board.
