Please join us for the latest installment in Wiley’s Federal Infrastructure Webinar Series, a series of webinars that brings together attorneys from across the firm to discuss current developments relating to the federal government’s ongoing, once-in-a-generation initiative to invest in improving the nation’s infrastructure and industrial supply chain.

This session will provide an update on the latest developments regarding the “Buy America” requirements that apply to federal infrastructure programs, including:

  • An examination of the Office of Management and Budget’s (OMB) latest guidance to agencies on implementation of the Build America, Buy America provisions of the Bipartisan Infrastructure Law, including OMB’s latest guidance on the standards for determining whether “construction materials” used in federal infrastructure programs were “produced in the United States”;
  • An overview of agencies’ implementation of the Build America, Buy America Act requirements, including a discussion of the National Telecommunications and Information Administration’s (NTIA) proposed waiver for certain manufactured products to be used in connection with the $42B Broadband Equity and Deployment (BEAD) program;
  • A review of the U.S. Department of the Treasury’s latest guidance on the domestic preference provisions in the Inflation Reduction Act (IRA), which provides “bonus credits” to certain clean energy projects that meet certain domestic content thresholds; and
  • A discussion of best practices and practical steps for ensuring compliance.
