Who can be held accountable for misappropriation of Trade Secrets? The Arkansas Uniform Trade Secrets Act answers this question, explaining that the following may be liable for trade secret misappropriation:

  • Individuals.
  • Corporations.
  • Business trusts.
  • Estates.
  • Trusts.
  • Partnerships.
  • Associations.
  • Joint ventures.
  • Governments.
  • Governmental subdivisions or agencies.
  • Any other legal or commercial entities.

Ark. Code Ann. § 4-75-601(3).

Selecting an appropriate target in litigation is often one of the first questions that an attorney and client discuss. In many cases, the answer is clear. However, in other cases, there may be more than one target, and the legal strategy agreed upon by attorney and client may be a complex one fought on multiple fronts. We routinely counsel clients through difficult situations involving trade secrets, and work with them to use unfair competition litigation as one possible option to pursue enforcement of their rights related to trade secrets.
