The United States District Court for Southern California is allowing this patent infringement case to proceed on a single claim that is not subject to an ongoing patent reexamination. (see prior uploaded document on this case).

This Notice advises the Court that because plaintiffs are not require to plead with particularity the specific patent claims that have been infringed within the complaint, and because the identity of specific claims is typically provided early during discovery in Preliminary Infringement Contentions, Plaintiff is proceeding to serve Limited Preliminary Infringement Contentions as to the one claim proceeding at this time.
