Four Star Meat Co, Inc. v Davilas & John Foods, et. al.

Painstakingly went after Defendants for non-payment of good received. Despite their default to respond, the Judge made us prove-up our case against Defendants. The DBA was let off the hook as we were unable to "prove" goods sold to them and had been paid by DBA in the past. The only thing that got us to get the Judgment against Defendants personally was luck - we had ONE cancelled check (thank God they bounced a check!) from Defendants showing that they had paid for the goods which presented sufficient evidence (in ADDITION to our hundreds of invoices signed by Defendants? for receipt of the goods) for the judge to FINALLY award judgment in favor of Plaintiff. $103K judgment for goods (meat) received and not paid for; we are still going after Defendants in collection. (of course!)
