Brief in Support of Defendant's Motion for Summary Judgment


Our client, Humble Abode, LLC, an Internet furniture retailer in California, was sued in New Jersey on a putative claim of trademark infringement and represented by a major regional law firm. We filed an answer and counterclaim that was considerably beyond what plaintiff was evidently expecting. Blogger and law professor <a href="">Eric Goldman surveyed the outcome</a> and expressed considerable surprise that even after a fairly favorable summary judgment decision for the plaintiff (459 F. Supp. 2d 310) -- which he <a href="">criticized sharply</a> -- the plaintiff paid our client to settle the case.
