This is a memorandum in support of the defendants' summary judgment motion to all counts of the plaintiff's Complaint. The summary judgment addresses claims for breach of contract, breach of a non-compete clause, fraud, and tortious interference with a contract. The matter was scheduled for hearing upon which the plaintiff immediately took a voluntary nonsuit at the commencement of the hearing. A motion for sanctions was subsequently filed by defendant against the plaintiff and its counsels.
