Belniak v. Marshall

Plaintiff's Complaint for Malicious Prosecution

This is a complaint for malicious prosecution. These types of cases are extremely hard to prove because of the malicious intent that must be proven against the Defendant. It is likely easier to prove malicious prosecution in the criminal context then in a civil context, but my client and I thought that the facts supported the allegations.

This case is still open. There have been several appeals to the Circuit Court and to the Fifth District Court of Appeals.
