Motion to Modify Judgment


On July 19, 2011, the Missouri Supreme Court ruled that the First Amendment did not prevent the government from criminalizing the communication of truthful, harmless information about rental properties. Despite this holding, the Court stated that Kansas City Premier Apartments would be exempt from regulation if it "merely wanted to advertise or provide information," but the Court offered no guidance as to what KCPA must do to comply with the law. In this filing, KCPA asks the Court to clarify the line between the information it may lawfully provide and the communications that the Court believes to be forbidden.
