Order Denying Defendants Motion for Reconsideration


This was an order in a trademark lawsuit denying Defendant's request to use the mark "Factory of Worms," (in connection with composting bins) after the Court enjoined Defendants (who sold competing goods under various names, including Howdy7 and Wormswrangler) from using "Worm Factory". I argued on behalf of the client that the two uses were equally likely to confuse, and the Court agreed.
