Rear End Car Accident with 3 Eyewitnesses v. Insurance Company Accident Reconstruction Expert - Demand Letter - Personal Injury


Cases where insurance companies act very unfairly to injured claimants are unfortunately all too common. This case involved a client who was rear-ended hard (according to three independent eyewitnesses to the event), suffering substantial truck damage and personal injuries. Amazingly, the insurance company hired an “accident reconstruction expert” who surveyed the damage, interviewed the at-fault driver, and came up with the “conclusion” that this was a “minor impact” at 10 m.p.h. or less! The insurance company stubbornly maintained this position all throughout the case while our client was undergoing medical treatment, insisting that it would not pay for medical treatment that was inconsistent with such a “minor impact.” Our firm ultimately settled this case for the insurance company’s policy limits, based on the strength of the eyewitness statements and the physical evidence gathered by the attorney. Note also that two previous law firms had taken and then dropped this client’s case, without doing the work necessary (i.e., having detailed interviews with all three of the eyewitnesses, doing physical inspections).
