This brief responds to the Government's arguments against takings liability for destroying the water quality in the St. Lucie River and Estuary. For years, the U.S. Army Corps of Engineers has been dumping polluted, toxic river into a canal leading directly to the Estuary. This has led to the growth of toxic algae blooms and smelly muck in the River. The Government wants to avoid liablity for causing the problems. The homeowners who live next to the River are seeking relief in an appeal not pending in the U.S. Court of Appeals for the Federal Circuit.
