Motion for Summary Judgment and Memorandum in Support


Homeowner sued a general contractor and a subcontractor, and settled with the subcontractor. Thereafter, the general sued the subcontractor directly, and the subcontractor argued that the homeowner was required to indemnify it under their settlement agreement.

The homeowner and subcontractor filed cross-motions for summary judgment on the language of the indemnity agreement. Wolfe Law Group represented the homeowner (Johnsons'), and argued that Johnsons' were not required to indemnify the subcontractor for its own negligence without expressly agreeing to the same.

There is dispute whether the indemnity agreement expressly did so.

This is the motion and memorandum in support of the homeowner's motion for summary judgment.
