Belniak v. Modern Day Construction, Inc, et. al.

Motion to Compel Discovery against Draftsman

Here is another Motion to Compel Discovery against the draftsman in a copyright infringement matter involving the infringment of an architectural work (blueprint). This particular Co-Defendant (PAR Custom Drafting, Inc.), was alleged to have previously infringed Plaintiff's blueprint (different blueprint). According to the Copyright Act, proof of intential infringement allows one to seek an increase their award of damages. As such, this motion to compel was in preparation to asserting and proving intentional infringement.
